3. Website Information
We aim to keep information on this website accurate and useful.
However, website content is provided for general information and should not automatically be treated as a formal quotation, construction specification, engineering opinion or contractual commitment.
Building requirements can differ substantially from one property to another.
A site inspection, measurements, drawings, specifications or further information may be required before a final quotation can be provided.
4. Requesting a Quote
Customers may contact us by telephone, email or through the website.
Submitting an enquiry does not create a contract and does not oblige Adrian McKenna Construction to undertake the work.
Any initial price discussed before the project has been fully assessed may be an estimate rather than a final fixed quotation.
Where appropriate, a written quotation will explain the work included and the proposed price.
5. Quotations
Unless stated otherwise, quotations are based on the information available when the quotation is prepared.
A quotation may be affected by:
- Changes requested by the customer
- Additional work
- Hidden defects or damage
- Unforeseen site conditions
- Structural issues
- Access difficulties
- Changes in specifications
- Additional materials
- Planning or regulatory requirements
- Work required by other trades
- Circumstances that could not reasonably have been identified beforehand
Where additional work is required, we will aim to discuss the matter with the customer before proceeding where reasonably practicable.
6. Scope of Work
The scope of each project will be based on the relevant quotation, specification, drawings or other written agreement between Adrian McKenna Construction and the customer.
Customers should review the proposed scope carefully and raise questions before agreeing to proceed.
Work that falls outside the agreed scope may be treated as additional work and may result in an additional charge.
7. Variations and Additional Work
Customers sometimes request changes after a project begins.
Where a customer asks us to alter the agreed work, additional costs or extra time may be required.
Where reasonably possible, changes should be agreed before the additional work is undertaken.
Some additional work may also become necessary because of conditions discovered after construction has begun, particularly in older properties, renovation projects, groundwork and structural work.
8. Deposits and Payments
Payment arrangements will be agreed for individual projects and may be included in the quotation or project agreement.
Depending on the nature of the work, this may include:
- A deposit
- Stage payments
- Material payments
- Progress payments
- A final balance
Customers are responsible for making payments in accordance with the agreed schedule.
Nothing in these Terms & Conditions removes any statutory rights available to consumers under Irish law.
9. Project Timescales
Any proposed commencement or completion date will be based on the information reasonably available at that time.
Construction schedules can be affected by matters outside reasonable control, including:
- Severe weather
- Material shortages
- Supplier delays
- Changes requested by the customer
- Unforeseen structural conditions
- Delays caused by other contractors
- Utility providers
- Planning or regulatory matters
- Site access
- Illness or emergencies
- Events outside our reasonable control
We will aim to communicate significant changes to the expected schedule.
10. Customer Responsibilities
Customers are responsible for providing accurate information relevant to the proposed work.
Depending on the project, customers may also be responsible for:
- Providing reasonable access to the property
- Confirming property ownership or authority to instruct the work
- Informing us of known hazards
- Providing relevant drawings or specifications
- Making agreed decisions within a reasonable time
- Arranging permissions or approvals assigned to them
- Keeping pets, children and other persons safely away from active work areas
- Making payments as agreed
Specific responsibilities may be set out separately for individual projects.
11. Planning Permission and Building Requirements
Some construction work may require planning permission, building regulation compliance, professional drawings, engineering input or other approvals.
The responsibility for arranging these matters will depend on the particular project and what has been agreed in writing.
Customers should not assume that planning, engineering, architectural or certification services are included unless expressly stated.
12. Materials
Where Adrian McKenna Construction supplies materials, we will aim to use materials appropriate to the agreed work.
Natural materials and manufactured products can sometimes vary slightly in appearance, texture, shade or finish.
Availability may also change.
Where a specified item becomes unavailable, an appropriate alternative may be discussed with the customer.
13. Existing and Hidden Conditions
Construction and renovation work can reveal problems that were not visible beforehand.
Examples may include:
- Damp
- Damaged timber
- Hidden pipework
- Electrical issues
- Poor previous workmanship
- Structural defects
- Weak foundations
- Drainage issues
- Unexpected ground conditions
Where this happens, additional work may be necessary.
We will aim to explain the issue and any effect on price or schedule before significant additional work is carried out where reasonably practicable.
14. Cancellation
Cancellation rights depend on how and where the contract was entered into, the type of work involved, whether work has started and applicable Irish consumer law.
Where a statutory cancellation or withdrawal right applies, nothing in these Terms & Conditions removes or restricts that right.
Where a customer asks us to begin work during a statutory cancellation period, specific consent or acknowledgement may be required.
Where no statutory right to cancel applies, any cancellation will be dealt with according to the quotation, project agreement and circumstances of the work.
Reasonable costs already incurred for authorised work, ordered materials or other project commitments may remain payable where legally permitted.
15. Quality and Problems With Services
We aim to provide construction services with appropriate care and skill and in accordance with the work agreed with the customer.
If a customer believes there is a problem with completed work, they should contact us as soon as reasonably possible and provide enough information for us to assess the matter.
Where we are legally responsible for an issue, we will deal with it in accordance with applicable Irish consumer law.
Nothing in these Terms & Conditions limits statutory consumer remedies.
16. Third-Party Contractors and Suppliers
Some projects may involve specialist contractors, suppliers or other trades.
We may coordinate with third parties where required to complete the agreed project.
Where a customer independently appoints another contractor, we are not responsible for that contractor’s work unless otherwise agreed.
17. Photos and Project Images
Photographs may occasionally be taken to record progress, workmanship or completed projects.
Images that identify a customer, private information or sensitive details should not be published for promotional purposes without an appropriate basis or permission.
Customers can contact us if they have questions about the use of project photographs.
18. Intellectual Property
Unless otherwise stated, website content including text, branding, graphics and original photographs is owned by or licensed to Adrian McKenna Construction.
Content must not be copied, reproduced or commercially reused without permission, except where permitted by law.
19. External Links
This website may contain links to websites operated by third parties.
These links are provided for convenience or additional information.
Adrian McKenna Construction is not responsible for the content, availability, security or privacy practices of independent third-party websites.
20. Liability
Nothing in these Terms & Conditions is intended to exclude or limit liability where doing so would be unlawful.
Nothing contained in these Terms & Conditions affects the statutory rights of consumers under Irish law.
Website information is provided for general informational purposes. Customers should obtain professional advice where a project requires architectural, engineering, planning, legal or other specialist expertise.
21. Privacy
Personal information submitted through the website will be handled in accordance with our Privacy Policy.
Our Cookie Policy provides further information about cookies and similar website technologies.
22. Changes to These Terms
We may update these Terms & Conditions from time to time.
Changes will take effect when the revised version is published on the website.
Terms applying to an existing construction contract will normally be those agreed in relation to that particular project rather than later website changes.
23. Governing Law
These Terms & Conditions are governed by the laws of Ireland.
Any dispute will be dealt with by the Irish courts having appropriate jurisdiction, subject to any mandatory consumer rights relating to jurisdiction or dispute resolution.
